The Minnesota Supreme Court grants review of Anders Erickson’s petition for review in State v. Douglas.

The Minnesota Supreme Court granted review in State v. Douglas to decide the following issue:

Whether the good-faith exception to the exclusionary rule applies to an unconstitutional warrantless search of a vehicle where law enforcement’s suspicion is based only on the smell of marijuana?

In a split precedential opinion, the Minnesota Court of Appeals concluded that the good-faith exception does apply and reversed the district court’s decision suppressing the evidence. See opinion below:
