Supreme Court Releases One Criminal Law Opinion:

State v. Gilbert, A21-1560 (Minn. Jan. 17, 2024)

In Gilbert, the supreme court reviewed the postconviction procedural bar articulated by the court in State v. Knaffla, 243 N.W.2d 737 (Minn 1976), and reached two conclusions:

  1. A postconviction court abuses its discretion by granting a petition for postconviction relief without explicitly ruling on the State’s argument that the claim is procedurally barred by Knaffla and without offering a sufficient explanation to support a determination that the claim is not procedurally barred by Knaffla.

  2. Gilbert’s postconviction argument that an expert presented false evidence at his trial was barred by Knaffla because the issue could have reasonably been raised at the time of his direct appeal.
